Federal and state law give your child important rights in special education — and give you, the parent, a powerful voice. Here’s an overview for New Jersey families.

Core rights under the law

Under IDEA, your child has the right to a free appropriate public education (FAPE) in the least restrictive environment, to a fair evaluation, and to an individualized program. As a parent, you have the right to participate in every decision, to consent to evaluations, to review records, to disagree, and to due process if needed. New Jersey adds its own protections on top of federal law.
